What the Florida statute says

Can a Florida city ban AR-15s?

Fla. Stat. § 790.33

“the Legislature hereby declares that it is occupying the whole field of regulation of firearms and ammunition, including the purchase, sale, transfer, taxation, manufacture, ownership, possession, storage, and transportation thereof”

No, and officials who try pay personally: up to a $5,000 fine, removal from office for a knowing violation, and damages up to $100,000 to people who sue. The Florida Supreme Court upheld those penalties in Fried v. State in January 2023. Florida has no assault weapon law.

Florida law in detail

  • Florida has no assault weapon ban, so a standard AR-15 configuration is legal to buy and build as it ships: pistol grip, adjustable stock, flash hider, detachable magazine.
  • Feature restrictions are a state question, not a federal one. Nothing in Florida law turns a common feature into a prohibited one.

The federal rule

There is no federal assault weapon ban; the 1994 federal ban expired in 2004. States that restrict them either name specific models or define an assault weapon by features such as a pistol grip, an adjustable stock, a flash hider or a threaded barrel, which is why featureless and fixed magazine builds exist.
